Article V. Resignation, Impeachment, and Removal of Executive
Board and General Assembly Representatives Section 1. Impeachment and Resignation of Executive Board
Members
A.
The General Assembly may bring impeachment charges
against an Executive Board member at a General Assembly meeting with a petition
signed by at least twenty (20) percent of the General Assembly. The General
Assembly shall hear the impeachment charges at the next General Assembly
meeting. By a two-thirds majority vote by secret ballot, the General Assembly
shall recommend dismissal from office. B.
Executive Board members are official representatives of
RHA at all events and meetings which they attend. Executive Board members may
bring impeachment charges against an Executive Board member. C.
An Executive Board officer proved to be guilty of
impropriety, as outlined by the Executive
Board Officers Contract, may be removed by impeachment. D.
An Executive Board officer who has charges of
impeachment pending shall be temporarily suspended from office until impeachment
proceedings are complete and a decision is rendered.
E.
An Executive Board officer may resign his/her position
by providing a letter of resignation to the Advisor. Section 2. Resignation and Removal of General Assembly
Representatives A.
A General Assembly representative may resign his/her
position by providing a letter of resignation to the President. B.
Recall of a General Assembly representative may be
initiated with a petition signed by at least five (5) percent of the
representative’s residence hall. Recall shall be decided by an election,
conducted by a Hall Council Advisor within ten (10) school days after the
petition is received by a RHA advisor, with recall enacted by a plurality of all
votes cast by the General Assembly representatives in a secret ballot
proceeding. Ratification of, Enforcement of, and Amendments to the
Constitution and Bylaws Section 1. This Constitution shall be fully ratified once approved by a
two-thirds majority vote of General Assembly representatives present, after its
submission to and approval by the Office of Student Engagement, and after its
submission to and approval by the Student Government Association. This document
will be in compliance with the policies of the Department of Residence Life and
Services. Section 2. The executive branch, with the advice and consent of the General
Assembly, shall enforce the Constitution and Bylaws. Failure to comply
with this Constitution may result in sanctions in accordance with the
Constitution of the Student Government Association. Section 3. A Standing Rules Document shall aid in the understanding of the
Rules of Order, Bylaws, and Constitution, without superseding the Constitution
and Bylaws. The Standing Rules will be reviewed by each Executive Board after
taking office. Additions and deletions will be made by the Executive Board;
these changes will not take effect until the General Assembly approves them with
a majority vote. Standing Rules may
be added to at any time by the General Assembly, and must pass with a majority
vote to be confirmed. The administrative aid may make grammatical corrections to
the standing rules document as needed. Section 4. A Rules of Order Document shall describe the function and flow of
the RHA meetings, without superseding the Constitution and Bylaws.
Additions and deletions will be made by the Executive Board; these
changes will not take effect until the General Assembly approves them with a
majority vote. Rules of Order may
be added to at any time by the General Assembly, and must pass with a majority
vote to be confirmed. The Administrative Aide may make grammatical corrections
to the Rules of Order Document as needed. Section 5. A Bylaws Document shall be used to add to the meaning of the
Constitution without superseding the original intent. Any member of RHA
may propose a bylaw. A two-thirds majority vote is required by the General
Assembly for passage. Section 6. A constitutional amendment shall supersede the section of the
Constitution which it amended. Any member of RHA may propose a
constitutional amendment. The amendment must be submitted in writing at
the previous regular meeting. A three-quarters majority vote is then
required by the General Assembly to ratify. The amendment is subject to
the approval of the Office of Student Engagement and the Student Government
Association. Amendments shall be in compliance with the policies of the
Department of Residence Life and Services. Section 7. Grammatical errors in the Constitution and or
Bylaws may be corrected by the Administrative Aide without approval of the
General Assembly representatives only if it receives the majority of the
Executive Board members’ support. The Administrative Aide must alert the General
Assembly representatives of any Constitution and Bylaw changes.
